Takin into consideration the fact that according to the requirements of the registration law, until the real estate transaction is registered it cannot be relied upon, at least against third parties, where a seller refuses to draw up a notarial deed the buyer will have to file such a claim. Now, the first question that presents itself about this claim is whether it is considered movable since it is the result of a contract or, on the other hand, because it is related to an immovable property, it should also be considered immovable and therefore should be raised in the court where the property is located. This article, on the occasion of criticizing the decision handed down by the 25th branch of the Supreme Court that resolves disputes among courts regarding jurisdiction, has examined the nature of the claim to oblige a seller to draw up a notarial deed concerning an immovable property. According to the research conducted, it seems that currently drawing up a notarial deed does not play a basic role in the contract of sale, and is an example of movables since its nature is commitment to carry out an act. It follows then, that a case to oblige a seller to draw up a notarial deed is also considered a movable and must therefore be filed in the place of residence of the defendant.
