The act of adjudication constitutes one of the central arenas in which the tension between legal order and substantive justice is manifested—a tension that permeates all domains of legal scholarship. This conflict, however, becomes particularly apparent in actions concerning civil liability. For instance, in a claim brought against the state and the judiciary by an individual who has been wrongfully arrestet (False Imprisonment), the court may, by moving beyond a rigid adherence to the principle of legal order (Legal Dogmatism), identify the range of rights available to the injured party, the mechanisms through which such rights may be asserted, and the appropriate method of compensating the resulting harm. Through such an approach, the court may approximate the ideal of justice and, potentially, foster social development and the public good.
Under this framework, minor procedural defects within the lawsuit do not necessarily impede the progression of judicial proceedings. Rather, judicial and administrative bodies may be obliged to provide compensation not only for pecuniary losses but also for non-material harm, including moral injury, deprivation of liberty, and lost personal benefits. Only within such a paradigm can the traditional institution of diya (blood money) be coherently extended to circumstances not explicitly addressed by jurisprudence or statute.
Nevertheless, uncertainties persist. It remains questionable whether courts would grant compensation for lost or frustrated opportunities, or whether judges would recognize claims brought by the relatives of an unlawfully detained individual for psychological distress. In all events, civil courts must remain mindful of procedural norms and the significance of legal order. The recommended judicial methodology is to seek an equitable resolution at the outset—abstracting from the strictures of statutory rules—before grounding the final decision in legal provisions so as to preserve procedural integrity and uphold the ideal of equal treatment before the law.
This approach is reflected, to a commendable degree, in the reviewed decisions of competent authorities; however, further refinement remains both possible and desirable.
